Terms of Service & Registry Operating Agreement

1.Nature of the Service & Cryptographic Verification

VirtualHumanID provides creators and studios with technical tools to generate tamper-evident records of digital creations. The platform performs three primary technical functions:

• Cryptographic Integrity & Canonicalization: Calculates exact SHA-256 digests and RFC 8785 JSON Canonicalization Scheme (JCS) manifests of uploaded reference media.
• Platform Timestamp Anchoring: Inscribes a VirtualHumanID Signed Platform Timestamp binding the canonical manifest to trusted world times (UTC, NPT, EDT, PDT).
• Visual & Biometric Fingerprinting: Analyzes 2D reference portraits to calculate 3D FaceMesh landmark topology (canonical ratios, bilateral symmetry) and perceptual hashes (DCT pHash-v2) for 1:N duplicate detection.

2.No Legal Advice & No Dispute Adjudication

The evidence packages, PDF certificates, and verification links produced by VirtualHumanID are technical records of prior existence. They are designed to be presented to platforms, sponsors, or legal counsel as factual evidence. VirtualHumanID:

• Does not offer legal counsel or represent users in disputes.
• Does not file copyright or trademark applications on behalf of users.
• Does not adjudicate, resolve, or act as an arbitrator in copyright or likeness disputes between multiple parties.

If a dispute arises regarding a registered persona, the platform records the claim in an append-only audit trail and updates the status to Disputed, leaving resolution to the relevant legal authorities or platforms.

3.User Warranties & Originality Declaration

By submitting an asset or registering a virtual persona on VirtualHumanID, you warrant and represent that:

• You are the original creator of the persona, or you possess explicit authorized agency from the rights holder to register the identity.
• The submitted media does not knowingly infringe upon the likeness, publicity rights, trademark, or copyrighted works of any living person or third party without authorization.
• You will not use the service to fraudulently establish prior claims to works created by others.

4.Privacy Tiers & Public Visibility Controls

In accordance with our strict privacy architecture, all registrations default to Unlisted Verification:

• Unlisted by Default: Your persona is not discoverable through public search engines or the public directory unless you explicitly opt in.
• Minimal Public Exposure: Visitors who possess your QR code or Verification Record ID are shown only a minimal verification summary.
• Asset Protection: Original raw assets are never made publicly downloadable and are accessible only by the authenticated owner.
• Irrevocability Notice: The owner acknowledges that while visibility can be switched between Public and Private, previously downloaded public verification copies or certificates cannot be recalled from third parties.

5.Do-Not-Train Policy Declarations

When registering an asset, creators may activate a Do-Not-Train declaration. You acknowledge that:

A Do-Not-Train preference serves as a formal public declaration of the creator's ethical reservation of rights against unauthorized scraping and AI model training. While recorded cryptographically in the canonical manifest and PDF certificates, it does not constitute a technical encryption barrier or guarantee that rogue third-party crawlers will respect the preference.

6.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HONGQIONG WORLD LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONTENT OBTAINED FROM THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR REGISTRATIONS OR ASSETS.

7.Governing Law & Jurisdiction

These Terms and your use of VirtualHumanID shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
